By accessing and using MiggoHub, you agree to be legally bound by these Terms of Service. If you do not agree with any part of these terms, you must not use our platform. By creating an account or using any functionality of MiggoHub, you confirm that you have read, understood, and accepted these terms in their entirety.

MiggoHub is an educational platform that provides:

• General educational information about the Australian immigration system, visa types, eligibility requirements, and migration processes based on official Australian government sources (Department of Home Affairs).
• Self-assessment tools to estimate points for skilled migration visas (subclass 189, 190, 491) according to officially published criteria.
• An AI-powered chatbot (OpenAI GPT-4) that answers general questions about Australian immigration in an educational manner.
• Connection with registered MARA (Migration Agents Registration Authority) migration agents for specific professional consultations (subject to your data sharing consent).

IMPORTANT: MiggoHub DOES NOT provide legal migration advice.

All information provided by MiggoHub (including chatbot responses, points calculators, and visa descriptions) is educational and indicative in nature only. It should NOT be interpreted as specific legal advice for your personal situation. Australian immigration laws are complex and change frequently. Points calculations are estimates based on published information and may not reflect recent changes in legislation or Department of Home Affairs policies.

For specific legal advice about your particular case, always consult with a registered MARA (Migration Agents Registration Authority) migration agent or a lawyer specializing in Australian immigration.

By creating an account on MiggoHub, you agree to:

• Provide accurate, current, and complete information during the registration process and keep it updated.
• Maintain the confidentiality of your password and be responsible for all activity under your account.
• Be responsible for the security of your account and notify us immediately of any unauthorized use.
• That MiggoHub is not responsible for losses arising from unauthorized use of your account without timely notification from you.

By using MiggoHub, you commit to:

• Use the platform only for lawful purposes and in accordance with these terms and all applicable laws.
• Provide truthful and accurate information in your profile and conversations with the chatbot.
• Not use the platform in a way that could damage, disable, overload, or impair our servers or networks.
• Not copy, modify, distribute, sell, or lease any part of our services without express authorization.
• Not use bots, scrapers, or automated tools to access the platform without our prior written permission.

All content on MiggoHub, including text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software, is the property of MiggoHub or its content providers and is protected by international intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, and revocable license to access and use MiggoHub for your personal and non-commercial use.

This license does not include the right to: resale or commercial use of the platform or its content, download or copy of information for the benefit of third parties, use of data mining tools, robots, or similar, any unauthorized use that modifies or alters the content.

When creating an account, you choose one of two data consent options:

MiggoHub uses third-party services to operate the platform:

• Registered MARA agents: we are a connection facilitator between users and professional migration agents. We are not responsible for the services, advice, or actions of third-party migration agents.
• OpenAI (GPT-4): we use the OpenAI API for natural language processing of the chatbot. Conversations are processed according to OpenAI's policies and are deleted after 30 days.
• Hosting and database services: we use trusted cloud infrastructure providers with robust security measures.

We are not responsible for the privacy policies or practices of third-party services. We recommend reviewing their terms of service independently.

While we strive to provide accurate and up-to-date information, MiggoHub does not guarantee that: all information is error-free or completely up-to-date in real-time, points calculators reflect the most recent changes in immigration policies, chatbot responses (generated by AI) are 100% accurate in all cases.

Always verify critical information directly with official Australian government sources (homeaffairs.gov.au) or consult with a registered MARA agent before making important migration decisions.

MiggoHub IS PROVIDED 'AS IS' AND 'AS AVAILABLE'.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the service will be uninterrupted, secure, or error-free, that defects will be corrected, or that the service or servers hosting it are free from viruses or other harmful components.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MiggoHub AND ITS DIRECTORS, EMPLOYEES, AGENTS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOOD-WILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM: (i) your access to or use of (or inability to access or use) the platform; (ii) any conduct or content of third parties on the platform; (iii) any migration decision made based on platform information; (iv) unauthorized access, use, or alteration of your transmissions or content.

We may suspend or terminate your account and access to MiggoHub immediately, without prior notice or liability, under our sole discretion, for any reason, including but not limited to violation of these Terms. You can delete your account at any time from Settings > Privacy > Delete My Data. Upon termination, your right to use the platform will cease immediately. All provisions of these Terms that by their nature should survive termination shall survive, including but not limited to intellectual property provisions, warranty disclaimers, indemnification, and limitations of liability.

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will try to provide at least 30 days' notice before the new terms take effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our platform after those revisions become effective, you agree to be bound by the revised terms. If you do not agree with the new terms, stop using the platform.

These Terms shall be governed and construed in accordance with the laws of [APPLICABLE JURISDICTION], without regard to its conflict of law principles. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
